What is a Revocable Living Trust?

A legal document established during a person’s lifetime that specifies how their property will be managed before and after their death.  A living trust also provides a plan for how those assets are to be distributed after his or her passing. A Revocable Living Trust avoids probate.

A legal document that is effective at your death. If you have minor children you can also name a guardian for these children in your Will.

A special court where disputes are resolved quickly and inexpensively.  The rules are simple and informal.  The person suing is the “Plaintiff”; the person being sued is the “Defendant”.  You may ask an attorney for advice before going to court, however an attorney may not represent you in Small Claims court.  Your claim cannot exceed $10,000 if you are a natural person (including sole proprietor); claim cannot exceed $5,000 if you are a business or public entity.

 

If your claim exceeds these amounts, you can give up your right to the amount over the limit or you may sue in the civil division of the trial court. You cannot, however, file more than two (2) cases in small claims court for more than $2,500 each during a calendar year.
